Authorization And Consent Form for Background Checks
We truly welcome your application for employment with Spinx. We are proud of our success and recognize it is the result of the quality
and caliber of the employees in our organization. You are applying for a position with a company whose employees take pride in themselves
and their job. In pursuit of that excellence we require, as a condition of employment, and/or continued employment, that all applicants consent
to and authorize a pre-employment verification of the background information submitted on their application and/or resume, which we may obtain
by means of consumer reports to prepare an investigative consumer report. The investigative consumer report may consist of contacting
all listed prior employers to verify your employment history. It may also include, but not be limited to, credit information reports, criminal history
reports and driving history records. Under the provisions of the Fair Credit Reporting Act (15 USC at 1681-1691u) as amended, before we can
seek such reports, we must have your written permission to obtain the information. You have the right, upon written request, to a complete
and accurate disclosure of the nature and scope of the investigation. You are also entitled to a copy of your Rights Under the Fair Credit Reporting
Act.
Under the provisions of the Fair Credit Reporting Act, 15USC, Section 1681 et seq., the Americans with Disabilities Act and all applicable
federal, state, and local laws, I hereby authorize and permit The Spinx Company, Inc. to now and/or at any time over the course of my
employment, administer a personality profile, require that I provide a fluid/breath specimen to be tested for the presence of drugs or alcohol,
obtain, via the consumer reporting agency of their choice, a consumer report and/or an investigative consumer report which may include the
following: My employment/work history records; Records concerning any, credit history, civil record, motor vehicle records, worker’s compensation
records (post-offer only), personal references, and any criminal history record pertaining to you which may be in the files of any Federal,
State, County or Local criminal justice agency in any State and/or other information deemed necessary to fulfill the job requirements; (For truck
drivers only) In accordance with the Department of Transportation Motor Carrier Safety regulations, Section 382.413, information concerning
alcohol and controlled substances for the past 2 years; Verification of my academic and/or professional credentials; and information and/or
copies of documents from any military service records.
The information received may include, but may not be limited to the aforementioned agencies and may include information as to my
character, general reputation, personal characteristics, and mode of living, which may be obtained by interviews with individuals with whom I
am acquainted or who may have knowledge concerning any such items of information. The results of this verification process will be used to
determine employment eligibility. Convictions for a felony or misdemeanor will not necessarily be a bar to employment.
I authorize the consumer reporting agency and any of its agents/designated representatives, to disclose orally, electronically, and in
writing the results of this verification process and/or interview to the designated authorized representatives of The Spinx Company, Inc.
I have read and understand this authorization and release, and I agree to the information verification. I do hereby authorize any person,
firm, or entity to provide all information that may be requested. I also do hereby agree to forever release and discharge all of the persons,
firms, or entities disclosing information and The Spinx Company, Inc., its agents and their chosen consumer reporting agency, and their associates
to the full extent permitted by law from any claims, damages, losses, liabilities, costs and expenses, or any other charge or complaint filed
with any agency arising from the request for, use of and/or disclosure of any requested information. I agree that any copy of this document is
as valid as the original.
I understand and acknowledge that under the provisions of the Federal Fair Credit Reporting Act, I am entitled to know if employment
was denied based on information obtained by my prospective employer, and to receive, upon written request, a disclosure of the public record
information and of the nature and scope of the investigation report.
